Terms of Service

1. Acceptance of Terms

By accessing or using the dFactoryIndex platform (“Service”), you agree to be bound by these Terms of Service. If you are entering into this agreement on behalf of a company or other legal entity, you represent that you have the authority to bind such entity.

2. Service Description

dFactoryIndex provides a manufacturing intelligence platform including digital twin operations, product lifecycle management, quality and traceability tools, and training management capabilities. Services are provided via cloud-hosted or on-premises deployment as specified in your subscription agreement.

3. Accounts and Access

You are responsible for maintaining the confidentiality of your account credentials and for all activities that occur under your account. You must notify us immediately of any unauthorized use.

4. Subscription and Payment

Subscriptions are billed monthly or annually as specified at the time of purchase. Prices are subject to change with 30 days notice. Failure to pay may result in suspension of access.

5. Data Ownership

You retain all rights to data you upload to or create within the Service (“Customer Data”). We do not claim ownership of your telemetry data, BOMs, documents, training content, or any other Customer Data. You grant us a limited license to process Customer Data solely to provide the Service.

6. Acceptable Use

You agree not to:

  • Use the Service for any unlawful purpose
  • Attempt to gain unauthorized access to any part of the Service
  • Interfere with or disrupt the Service or servers
  • Reverse engineer, decompile, or disassemble any part of the Service
  • Resell or redistribute access to the Service without written consent

7. Intellectual Property

The Service, including its design, features, and documentation, is owned by dFactoryIndex and protected by intellectual property laws. Your subscription grants you a non-exclusive, non-transferable license to use the Service during the subscription term.

8. Limitation of Liability

To the maximum extent permitted by law, dFactoryIndex shall not be liable for any indirect, incidental, special, consequential, or punitive damages arising out of or related to your use of the Service. Our total liability shall not exceed the amount you paid for the Service in the 12 months preceding the claim.

9. Termination

Either party may terminate the subscription with 30 days written notice. Upon termination, we will provide a 30-day window to export your Customer Data. After this window, Customer Data may be deleted.
